Public hearings will address the following themes:
a) The proper construction of the Water Act 2007 (Cth) concerning the determination of the long term average sustainable diversion limit, which must reflect an “environmentally sustainable level of take”;
b) The application of the Water Act by the MDBA (‘the triple bottom line’), particularly in determining the ‘environmentally sustainable level of take’, and the processes involved in such adoption;
c) The statutory consequences of the approach taken by the MDBA
The evidence as to what is an 'environmentally sustainable level of take'.
Assessing the 36 supply measures as part of the SDL Adjustment Mechanism.
The Northern Basin Review.
Efficiency measures and the 450GL.
Whether the Basin Plan has been developed and implemented with regard to Indigenous issues (s21(4)(c)(v), Water Act):
a) Whether Water Resource Plans are being prepared in regard to the view of Indigenous people with respect to cultural flows (s10.54,Basin Plan 2012);
b) Whether the Water Resource Plans or draft plans identify and have regard to the matters outlined in s10.52 and 10.53 of the Basin Plan.
Progress on Environmental Outcomes including:
a) Water recovery to date;
b) Darling River and Menindee Lakes;
c) Ecological health of the Murray-Darling Basin.
Compliance and enforcement issues.
